Data Retention Policy

This Data Retention Policy outlines how MyAccounts (provided by Excel Business Services) manages the retention and deletion of data, ensuring compliance with legal obligations and the General Data Protection Regulation (GDPR).
1. Purpose of Retention
We retain data for the following primary purposes:
- To provide the Service and maintain your account history.
- To comply with statutory record-keeping obligations imposed by the Revenue Commissioners and other regulatory bodies.
- To resolve disputes and enforce our agreements.
2. Retention Periods
We apply the following retention periods to different categories of data:
2.1 Financial Records & Receipts
Retention Period: 6 years + current year.
Reason: Under the Taxes Consolidation Act 1997 and Revenue Commissioners guidelines, businesses must retain books and records for six years. Since MyAccounts serves as a digital repository for these records, we default to this standard to protect our users.
2.2 Account Information
Retention Period: Duration of active account + 1 year after closure (unless linked to financial records).
Reason: To allow for account reactivation (within a grace period) and to handle any post-termination queries.
2.3 Enhanced Reporting Requirements (ERR) Data
Retention Period: 6 years.
Reason: Compliance with Finance Act 2022 requirements for reporting non-cash benefits.
2.4 Marketing Data
Retention Period: Until consent is withdrawn or after 2 years of inactivity.
Reason: To ensure we only communicate with engaged users.
3. Post-Termination Retention
If you cancel your subscription or terminate your account:
- Your data will generally be retained for a grace period of 90 days to allow you to download your records.
- After the grace period, we may delete your data unless we are legally required to retain it (e.g., if you have not exported your financial records, we may hold them to ensure you meet your 6-year obligation, subject to storage fees or specific arrangements).
- Important: You are responsible for exporting your data before closing your account. We are not liable for data loss after account termination.
4. Secure Deletion
When data has reached the end of its retention period or upon a valid erasure request:
- Digital Records: Files and database entries are permanently deleted from our active servers and backups.
- Backups: Data in backups may remain for a short period (up to 30 days) until overwritten in the normal backup cycle, but will be put beyond use.
5. User Erasure Requests
You may request the deletion of your personal data ("Right to be Forgotten") by contacting privacy@excelbusinessservices.ie. However, please note:
- We cannot delete data that we are legally required to retain (e.g., financial transaction records required for tax audit purposes).
- We will inform you if we cannot comply with your request due to a legal obligation.
